Slimed

Unfortunately the court's process slimes the innocent while protecting the rights of the accused.  My mother had to provide a deposition to the defendant's attorney to establish probable cause for injunction against the accused.  This event is done at considerable cost to the defendant.  The deposition was administered with some irregularities!

The venue for the deposition was done in the office of the attorney for the defendant.  Okay, so?  My mother's advocate for domestic abuse was not informed as to the location for the deposition, and the defendant was in close proximity of my mother (in violation of at least the "spirit" of the restraining order).

Thank God for the guy wearing the "white hat", my older brother.  When he spied the vehicle of the defendant parked at the attorney's office he called the advocate and the DA stating that mother would not give her deposition with the defendant present.  The advocate was irate for being kept in the dark about the location for the deposition.  The DA insisted to my brother that the deposition had to be given and my "white hatted" brother insisted on the conditions that had to be met before our mother would come forth.  My older brother who has been involved in other court depositions pointed out to the DA that it was most unusual for the deposition to take place outside the courthouse and in the hostile territory of the attorney's office for the defense.  He proceeded to take photos to the great discomfort of the DA.

YIKES!!  So this is how you treat an 86-year-old mother who has after decades of being a silent victim of domestic abuse comes forward and reports an assault? What had the defendant's attorney and DA have planned for my mother?  Was it collusion for expedience?
